When, and if, the total fees charged to a task equal or exceed seventy five percent (75%) of the notification limit for the task at the time of the monthly billing, Garber Engineering will contact the City of Pleasanton to discuss the matter. The discussion will cover the likelihood of the notification limit being exceeded and the best manner to proceed. Garber Engineering will not bill more than the notification limit without written permission to do so from the City of Pleasanton. Garber Engineering believes that the notification limits given in the Table of Compensation should be adequate under most circumstances. The actual fee may be well under the notification limits. Please be aware, however, that Garber Engineering does not warrant that it can complete all work described in the Scope of Work under all circumstances. If various difficulties beyond Garber Engineering's control cause the billings to reach the notification limits and the City of Pleasanton decides that the billing limits should not be increased to a level which will allow completion of the work, Garber Engineering will only perform work until the agreed upon billing limits are reached, whether or not the work described in the Scope of Work is complete Time and materials fees are based on the attached Rate Schedule.
