2.04 Ec~Liai Opportunity Employer. <br />CPS shall comply with any applicable equal employment statutes <br />and regulations. <br />2.05 Public Records Law. <br />CPS shall comply with any applicable laws governing the <br />confidentiality and accessibility to the public of any documents, <br />or portions thereof, generated under this Agreement. <br />ARTICLE III <br />TIME OF PERFORMANCE <br />3.01 Installation of Terminals. <br />CPS shall install all necessary Terminals at the designated <br />locations within thirty (30) days of execution of this agreement. <br />ARTICLE IV <br />DUTIES OF THE CLIENT <br />4.01 Environmental Requirement. <br />Client agrees to provide access to electrical power and work <br />area and access to a non-proprietary telephone line. Terminals <br />will be programmed by CPS for network access with either a local <br />telephone number or a toll-free (800) number. <br />4.02 System Operation. <br />{a) The Client will transact qualified Card payments made by <br />the Client's customers to CPS for the payment of taxes, licenses, <br />tuition and other fees the Client charges and for which it wishes <br />to accept payments through CPS. The Client agrees to use the <br />forms, supplies and equipment furnished by CPS for all <br />transactions. The Client agrees to prominently display the CPS <br />Service Fee schedule and Bankcard signage provided by CPS. During <br />the term and any subsequent renewals of this Agreement, the Client <br />agrees not to enter into an agreement with any other financial <br />institution, credit card service provider, credit card company or <br />other company to provide services for electronic point of sale <br />services or the operation of a credit card program that involves <br />charging a service fee to the customer. The Client understands <br />that CPS may amend the Operating Guide from time to time. The <br />Client shall utilize the Terminals to authorize all transactions <br />initiated with a Qua~.ified Card when the system is operable. The <br />Client shall prepare a sales draft or transaction record for every <br />sale utilizing the system. The Client agrees to use its best <br />efforts to ensure that each transaction is not subject to any <br />8 06/06/91 <br />
