disputes, setoffs, or counterclaims, that each statement in all <br />transaction records or sale drafts are true and that the Client has <br />no knowledge which would impair the validity of each transaction. <br />Each sales draft and/or transaction record (as an example only, see <br />Exhibit 1) shall be fully completed and must include: <br />(1) the cardholder's account number; <br />(2) the signature of the cardholder or authorized user; <br />(3) the date of the transaction; <br />(4) the Client's name, location and identification <br />number; <br />(5) the total amount of the transaction (including <br />applicable amount due the Client and the CPA <br />account fee); <br />(6) an adequate description of the taxes, licenses, <br />tuition or fees being paid for; and <br />(7) all disclosures, if any, required by law. <br />(8) at the Client's option, each sales draft <br />and/or transaction record may include: <br />(1) Operator's ID number; or <br />(2) Folio/case/customer/department number. <br />The Client shall deliver a completed copy of the sales draft <br />to the cardholder or authorized user at the time each transaction <br />is consummated. All sales drafts prepared by the Client shall <br />represent obligations of the cardholder in the amount set forth <br />therein. All sales drafts prepared by the Client for Qualified <br />Card Transactions shall not involve any cash advance or element of <br />credit for any other purpose. The Client shall forward copies of <br />all sales drafts to CPS which will maintain copies of the sales <br />drafts for a period of two (2) years from and after the date of the <br />transaction. The Client will retain their copy of the sales draft <br />for as long as required by applicable law. The Client will make no <br />cash refunds to cardholders on Qualified Card Transactions. <br />(b) The Client, if making a credit card transaction without <br />presence of the actual credit card, in addition to using its best <br />efforts to comply with paragraph 4.02(a), will: <br />(1) Obtain cardholder's name and account <br />number from Cardholder; <br />(2) Enter the transaction using the key <br />option on the electronic terminal; <br />9 06/06/91 <br />
