Resolution No. PC-89-89 <br />Page 2 - October 11, 1989 <br />3. The design of the subdivision and proposed <br />improvements will not cause substantial <br />environmental damage or substantially and avoidably <br />injure fish or wildlife or their habitat. <br />A Negative Declaration was adopted prior to this <br />subdivision application in conjunction with the PUD <br />which was approved for the project (PUD-82-16). <br />The Negative Declaration was based on the <br />determination that the project would not create <br />significant environmental impacts. No waterways or <br />wildlife habitat were identified on the site in the <br />initial study which was undertaken for the project. <br />4. The design of the subdivision is not likely to <br />cause serious public health problems. <br />The subdivision application is for the creation of <br />seven (7) single family custom homes. All public <br />services to serve the new lots, including water, <br />sewer and storm drainage, are included within the <br />scope of the project. Therefore, the project is <br />not likely to cause any health problems. <br />5. The design of the subdivision or its related <br />improvements will not conflict with easements, <br />acquired by the public at large, for access through <br />or use of property within the proposed <br />subdivision. <br />The design of the subdivision includes street <br />right-of-way dedications to provide for public <br />access to the newly created lots on Foxbrough <br />Place. The existing public street known as Gray <br />Fox Circle wil]_ provide access to the private <br />driveway serving Lots 6 and 7 in Tract 5902. A <br />portion of an existing easement across the property <br />will be abandoned to relocate a storm drain line in <br />the center of the new public street, Foxbrough <br />Place, along with new water and sewer lines. <br />Therefore, the subdivision would not conflict with <br />existing easements. <br />WHEREAS, the proposed subdivision conforms to the PUD ordinance; <br />and <br />WHEREAS, the environmental issues concerning this project were <br />addressed in a Negative Declaration which was adopted <br />for the original and modified planned unit development <br />approvals. <br />-2- <br />
