That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detrimental to the public <br />health, safety or welfare, or be materially <br />injurious to the properties or improvements in the <br />vicinity. <br />Rose Pavilion will have Code-required off-street <br />parking and loading facilities which will be <br />sufficient for the use. Noise levels generated <br />will be satisfactory for neighboring uses. Truck <br />and building refrigeration units will not cause <br />nuisance noise as there are no residences in the <br />vicinity of the site. Dumpsters are in place or <br />are proposed to accommodate project-generated <br />refuse. Although open 24 hours per day, there are <br />no sensitive uses to be bothered by either the use <br />itself, parking lot activity, or project-generated <br />traffic during night-time hours. All loading will <br />take place in the rear of the building, avoiding <br />interference with adjoining uses. Litter and other <br />such problems associated with market uses will be <br />minimized due to the primary bulk purchase nature <br />of the operation, elimination of outdoor storage of <br />merchandise, and clean-up conducted as part of the <br />shopping center maintenance. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of the Zoning <br />Ordinance. <br />The supermarket would be required to adhere to the <br />sign ordinance (the overall sign program of the <br />center conforms), the use will be conducted <br />entirely indoors, except as allowed by Code for <br />special events, required off-street parking and <br />loading are incorporated into the design of Rose <br />Pavilion Shopping Center, and the use will not be <br />hazardous nor cause nuisance to neighboring <br />properties. Recycling facilities will be provided, <br />will be screened, and kept litter-free, as required <br />by Code. These are requirements of the design <br />approval for the construction of the building which <br />will house the use. <br />WHEREAS, the Planning Commission finds this project is <br />categorically exempt from the requirements of the <br />California Environmental Quality Act (minor land use <br />entitlement). Prior environmental reviews which <br />evaluated this type of use at this location found no <br />significant environmental effects (Rose Pavilion, Phases <br />I and II, Negative Declaration). <br />
