Resolution No. PC-90-96 <br />Page 4 <br />dedicate in fee title to the Alameda County Flood Control and <br />Water Conservation District Zone 7 land located at the <br />southwest corner of the site at the connection of Tassajara <br />Creek with the Arroyo Mocho Canal in order to provide a 35' <br />inside turning radius connecting the Arroyo. Mocho and <br />Tassajara Creek top-of-bank access roads. <br />17. All private street curbs shall be red painted and shall be <br />posted as a "Fire Lane - Tow Away Zone" to the satisfaction of <br />the Fire Marshall. <br />18. Unless otherwise approved by the Director of Planning, the <br />applicant shall locate the finished garage floor elevations as <br />close as possible to the 100 year flood elevation. Grade <br />elevations must consider possible archaeological mitigation as <br />identified in the approved PUD. <br />19. All internal private streets, common landscape/open space <br />areas, and recreation amenities shall be maintained by a <br />single Homeowners Association created by the Declaration of <br />Covenants, Conditions, and Restrictions (CC&R's) for the <br />property approved under PUD-81-30-23M and PUD-81-30-50D. The <br />CC&R's shall be recorded with each of the four lots covered by <br />this tract prior to sale or transfer. Prior to recordation, <br />the CC&R's shall be reviewed by the Director of Planning and <br />City Attorney and shall include, but not be limited to, the <br />following items: <br />a. Only one Homeowners Association is allowed to control the <br />development approved under PUD-81-30-23M and PUD-81-30- <br />50D. <br />b. All residents shall have access to and use of all common <br />open space and amenity areas of the development approved <br />under PUD-81-30-23M and PUD-81-30-50D. <br />c. All project phases of the development approved under <br />PUD-81-30-23M and PUD-80-30-50D shall annex into the <br />single Homeowners Association, and, conversely no <br />deannexations shall be allowed. <br />d. Changes to the CC&R's shall be reviewed by the City <br />Attorney and Director of Planning for consistency with <br />the above-mentioned items. <br />20. The internal property lines created by this tract shall <br />maintain a minimum 5' distance from any building wall. <br />21. That this subdivision is subject to all conditions shown in <br />the Report from Engineering Services dated October 5, 1990 <br />attached hereto. <br />
