EBHIBIT B <br />Conditions of Approval - PIID-9o-10 <br />September 26, 1990 <br />1. That the proposed development shall conform substantially to <br />the site plans, elevations, and related materials, Exhibit A <br />(dated "Received August 31, 1990"), on file with the <br />Planning Department, except as modified by these conditions. <br />2. That, except as otherwise modified by the development plan <br />or conditions of approval, the uses and site development <br />standards for the development shall be those of the RM-4,000 <br />zoning district. <br />3. That the developer shall establish a homeowners association <br />through the CC&R's for the project. The association shall <br />be responsible for maintaining all common open space, <br />private utilities, private streets, project walls, and other <br />common areas and improvements within the development. The <br />City shall be granted the rights and remedies of the <br />association, but not the obligation, to enforce the <br />maintenance obligations. The City Attorney shall review and <br />approve the proposed CC&R's prior to the recordation of a <br />final subdivision map for the project. <br />4. That the applicant shall submit a detailed plan for the <br />landscape strip area along the east side of the project wall <br />adjacent to the shopping center service driveway for review <br />and approval by the Planning Director prior to the issuance <br />of any building permits for the project. <br />5. That responsibility for the installation and long-term <br />maintenance of the landscape strip along the east side of <br />the project wall adjacent to the shopping center service <br />driveway shall rest with the homeowners association. <br />6.
