8. That a minimum of 20$ (or 4) of the units within the project <br />shall be sold to owner-occupant home buyers whose incomes do <br />not exceed the "moderate income" level (i.e. no more than <br />120$ of the median income level for the Alameda and Contra <br />Costa county areas) as described in the Planning Commission <br />staff report. The goal of the moderate income program shall <br />be to provide these 4 units at the lowest possible .price. <br />Toward that end, the City agrees to waive all City fees for <br />the 4 moderate income townhouse units. The details of the <br />moderate income program shall be prepared by the applicant <br />and submitted for review and approval by the Planning <br />Commission prior to submittal of the tentative map. <br />9,. That the applicant shall submit a supplemental noise <br />analysis to address the question of whether additional noise <br />protection (i.e. a 2 foot plexiglass or masonry wall <br />extension) is necessary surrounding the front patios of the <br />four units which face Bernal Avenue (Units 1 through 4). <br />The study-shall be submitted for review and approval by the <br />Planning Director prior to recordation of the final map, and <br />the design of the patios shall be modified as deemed <br />necessary to meet the noise mitigation measures recommended <br />in the study. <br />10. That the proposed driveways on Palomino Drive shall be <br />changed from the street-type opening to a standard driveway <br />curb cut. The final design shall be subject to review and <br />approval by the City Engineer prior to recordation of the <br />final map for the project. <br />il. That the proposed sanitary sewer shall tie into the public <br />sanitary sewer line on Palomino Drive. <br />12. That, if adequate capacity exists, all on-site storm drains <br />shall tie into the catch basin on Palomino Drive and the <br />proposed storm drain to Bernal Avenue shall be eliminated. <br />13. That all on-site utilities and streets shall be private and <br />shall be maintained by the homeowners association <br />established for the development. <br />14. That, wherever practical, the curb return radii within the <br />private driveway system shall be increased to a minimum of <br />10 feet. <br />15. That the driveway behind Unit 20 shall be extended easterly <br />to allow sufficient backing and turning area for a vehicle <br />backing out of the Unit 20 garage. This modification shall <br />be subject to review and approval by the City Engineer prior <br />to the recordation of the final map for the project. <br />
