:.~~, ~=The applicant shall comply with all conditions listed in the <br />° Engineering Services Memorandum for Tentative Map Tract 6339, <br />-dated September 12, 1990. <br />g:~;'. The"applicant shall record with the final map, CC&R's which <br />shall create a Homeowners Association. Said CC&R's shall be <br />reviewed and approved by the City Attorney and the Director of <br />Planning prior to recordation of the final map. <br />The Homeowners Association shall be responsible for the <br />following: <br />a. Irrigate and maintain the landscape area located between <br />the street curb and soundwall facing the northside of <br />Vineyard Avenue, and between the street curb and <br />soundwalls on lots 1 and 22; <br />b. Maintain the soundwalls facing both the north side and <br />west side of Vineyard Avenue; and <br />c. Maintain the storm drain line, and drainage release <br />between lots 6 and 7, and the valley gutter at the rear <br />of lots 7 through 16. <br />The Declaration of CC&R's shall state that if the Homeowners <br />Association fails to maintain the landscape condition stated <br />above, the City shall have the right to enter onto the <br />property, after prior notice to the Association to enforce <br />these landscape maintenance responsibilities and shall bill <br />the Homeowners Association for all associated costs. <br />9. The applicant shall underground all existing overhead utility <br />lines per the Pacific, Gas, and Electric construction drawing, <br />June 27, 1990, to the satisfaction of the City Engineer. <br />10. -All grading, public street improvements, utility improvements, <br />and the installation of soundwalls and landscaping along <br />Vineyard Avenue shall be completed to the satisfaction of the <br />City Engineer and the Director of Planning prior to issuance <br />of building permits. <br />11. All graded slopes and <br />. the applicant prior to <br />by the City Engineer. <br />12. That with recordation <br />dedicate any underlyi <br />Vineyard Avenue along <br />the City. <br />building pads shall be hydroseeded by <br />acceptance of subdivision improvements <br />of the final map, the applicant shall <br />ng fee interest that he may have in <br />the easterly project property line to <br />13.
