A negative declaration was adopted prior to this
subdivision application in conjunction with the
project PUD approval, because it was determined
that the project would not create significant
environmental impacts. As a part of the project
initial study, no waterways or wildlife habitat
were identified on the site.
4. The design of the subdivision is not likely to
cause serious public health problems.
The subdivision is for the creation of 12
condominiums. All public services, including
water, sewer and storm drainage are currently
existing for the project and are included within
the scope of the project.
5. The design of the subdivision or its related
improvements will not conflict with easements,
acquired by the public at large, for access through
use of, property within the proposed subdivision.
The project site already contains all related
public improvements. Conditions of approval will
preclude conflict with public easements.
WHEREAS, the Planning Commission made the following findings as
per the City's Condominium Conversion Ordinance:
1. The proposed conversion meets all of the
requirements of the condominium conversion chapter
(Chapter 17.04) of the ordinance and the purpose of
the district in which the site is located.
One purpose of the condominium conversion chapter
is to provide for the housing needs of all segments
of the community, while minimizing or avoiding
hardship caused by the displacement of residents
following conversion of their dwellings,
particularly senior citizens and the handicapped.
Another is to reduce tenant displacement by
encouraging ownership of lower cost residential
units by prior renters. As conditioned, the
proposed conversion will provide purchase
assistance to tenants to encourage them to stay and
purchase their unit. It will also provide
relocation assistance for those tenants who prefer
to move, and it will allow elderly and handicapped
tenants to continue leasing their unit if they
choose.
2. The proposed conversion is consistent with General
and Specific Plan policies.
