The proposed conversion is consistent with General <br />Plan policies of maintaining at least 50% rental <br />multi-family units. The percentage of multi-family <br />rental units in Pleasanton will remain <br />approximately 8% above the General Plan standard <br />with the proposed conversion. In addition, the <br />project will help to meet the need for smaller <br />affordable "for-sale" units in Pleasanton, and is <br />consistent with the policies of the Downtown <br />Specific Plan. <br />3. The proposed conversion will be appropriate as a <br />condominium project in regards to its age, <br />condition, location, or any other matter affecting <br />its continuing viability as an ownership project. <br />The project's site, design and general condition <br />has been deemed excellent by the Planning <br />Commission and City Council in previous PUD <br />analyses. The reduced provision of on-site parking <br />has been deemed appropriate due to the small unit <br />size of the project. The Building Department has <br />ascertained that the building meets Building Code <br />requirements for conversion to condominiums. <br />4. The applicant has not evicted a tenant immediately <br />before or during the condominium conversion process <br />in violation of Section 17.04.130B of this chapter. <br />There has been no indication from tenants that <br />there has been any eviction(s). From the <br />information received, it appears that most of the <br />tenants have resided in the subject apartments for <br />as long as two years with only three having resided <br />there for three months. <br />WHEREAS, as conditioned, the conversion of these apartment units <br />into affordable "for-sale" housing would be an asset to <br />the Downtown District. The project will help to meet the <br />need for smaller affordable "for-sale" units in <br />Pleasanton. The project is in conformance with the <br />City's Condominium Conversion Ordinance and the State <br />Subdivision Map Act. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br />Section 1. Approves Tract 6314, the application of George <br />Marment to convert 12 apartments located at 50-78 Peters <br />Avenue into condominiums subject to the conditions shown <br />on Exhibit "A" attached hereto and made part of this case <br />by reference. <br />
