EXHIBIT B CONDITIONS OF APPROVAL PV-1531PADR-1536, Finlay Boag 4558 Second Street September 19, 2006 1. The proposed additions shall conform substantially to the site plan, floor plan, elevations, and related materials, Exhibit A (dated "Received" May 1, 2006), on file with the Planning Department, except as modified by these conditions. Minor changes to the plans may be allowed subject to the approval of the Planning Director if found to be in substantial conformance with the approved exhibits. 2. The variance and design review approvals will lapse one year from the date of approval, unless prior to the expiration, construction has commenced and diligently pursued toward completion, or an extension has been approved by the City. 3. The applicants shall pay any and all fees to which the project may be subject prior to issuance of a building permit. The type and amount of the fees shall be those in effect at the time the permit is issued. 4. All appropriate City permits shall be obtained prior to the construction of the additions. 5. Construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. No construction shall be allowed on Federal Holidays. If future complaints are received regarding the construction hours, the Planning Director may modify the construction hours. The Planning Director may allow earlier "start-times" for specific construction activities (e.g., concrete-foundation/floor-pouring) or due to weather. All construction equipment must meet DMV noise standards and shall be equipped with muffling devices. 6. The plan check materials will be accepted only after the completion of the variance and design review procedures' 15-day appeal period (15 days from the date of the approval letter), unless the applicants submit a signed statement acknowledging that the plan check fees may be forfeited in the event that the approval is overturned or the design is significantly changed as the result of an appeal. In no case will a buildino permit be issued prior to the exoiration of the 15-dav aooeal oeriod. 7. Unless otherwise approved by the Planning Director, the exterior colors and materials of the additions shall match those of the existing structure. 8. The applicants shall use "high definition" composition roof shingles on the existing house and additions. A roof material sample or manufacturer's brochure shall be submitted to the Planning Director for review and approval prior to installation. 9. A detail of the wrought iron railing shall be shown on the plans submitted for issuance of building permits and shall be subject to review and approval by the Planning Director prior to issuance of a building permit.
