<br />information shall be submitted to the Planning Director for review and approval <br />prior to occupancy of the first unit. <br /> <br />35. No masonry wall shall be constructed along Cameron Avenue. <br /> <br />36. The applicant shall work with the City on the project's Affordable Housing <br />Agreement, which shall be subject t the approval of the Housing Commission and <br />the City Council. <br /> <br />Disclosures <br /> <br />37. The recorded deed of sale for all lots covered by this PUD Development Plan <br />approval shall include the following: <br /> <br />a. A clause stating the existence of the Zone 7 lake located on the east side of <br />Martin Avenue is a reclaimed Kaiser quarry pit. <br /> <br />b. A clause indicating the close proximity of the Livermore Municipal Airport; <br />the possible impacts to homes due to aircraft overflights; a warning that the <br />noise generated from the Livermore Airport is a mix of business jet and <br />small aircraft operations; that the Livermore Airport operates 24 hours per <br />day, 365 days per year; and that the Livermore Airport has proposed an <br />expansion of the airport. <br /> <br />The project developer shall submit the wording for this notice to the City Attorney <br />for review and approval before recordation of the final subdivision map. <br /> <br />TentativelFinal Subdivision Map Requirements: <br /> <br />38. The project developer shall record CC&R's at the time of recordation of the final <br />subdivision map, which shall create a property owners association or as <br />maintenance association for this development. The property owners/maintenance <br />association shall include Lots 4 through 27. The CC&R's shall be subject to the <br />review and approval of the City Attorney prior to recordation of the final subdivision <br />map. The property owners/maintenance association shall be responsible for the <br />maintenance of the bio-retention areas adjoining Street A and the public right-of-way <br />landscaping between the sidewalk and curb facing Cameron Avenue. The City shall <br />be granted the rights and remedies of the association, but not the obligation, to <br />enforce the maintenance responsibilities of the property owners/maintenance <br />association. <br /> <br />39. The project developer shall prepare development standards for inclusion within the <br />CC&R's for decks, patio covers, pools, and other accessory structures for review <br />and approval by the Planning Director prior to approval of a final subdivision map. <br />The standards shall conform to the development stated in these conditions. <br /> <br />10 <br />
