<br />ATTACHMENT n <br /> <br />ARTICLE II -- ZONING REQUIREMENTS <br /> <br />Section 17.44.040. General Req uirements/ Applicability. <br /> <br />A. Residential Development <br /> <br />For all ncw Multiple Family Rcsidcntial Projects of 15 units or more, at lcast 15% of the <br />project's dwelling units shall be affordablc to Very Low, and/or Low Income houscholds. <br />For all new Singlc Family Residcntial Projccts of 15 units or morc, at Icast 20% of the <br />project's dwelling units shall be affordablc to Very Low, Low, and/or Modcratc Income <br />householdsc . For all Condominium Convcrsion proiccts approvcd pursuant to Chapter <br />17.04 of the Plcasanton Municipal Codc of 15 units or morc. at least 25% ofthc proiects <br />dwclling units shall be affordablc to Verv Low. and Low and/or Moderate Income <br />households. Thcsc dwelling units shall bc rcferred to as "Inelusionary Units". Spccial <br />considcration will be given to projccts in which a significant percentagc ofthc <br />Inelusionary Units are for Very Low and Low Income houscholds. The specific mix of <br />units within thc three affordability catcgories shall be subjcct to approval by thc City. <br /> <br />Proiects with lcss than 15 units are encouraged to provide Inelusionarv Units. Projccts <br />with less than 15 units arc subiect to paving the City's Lower Incomc Housing Fec as set <br />forth in Chaptcr 17.40 of the Municipal Codc <br /> <br />The Inclusionary Units shall be reservcd for rent or purchase by eligiblc Vcry Low, Low, <br />and Moderate Income Houscholds, as applicable. Projccts subject to thesc rcquircmcnts <br />includc, but are not limited to, singlc-family detached dwellings, town homes, apartmcnts, <br />condominiums, or coopcrativcs provided through new construction projects, and/or <br />through convcrsion of rentals to owncrship units. <br /> <br />The percentage of Inelusionary Units requircd for a particular project shall bc dctermined <br />only oncc on a givcn project, at thc timc of Tentative Map approval, or, for projects not <br />proccssing a map, prior to issuance of building pcrmit. If the subdivision dcsign changcs, <br />which results in a changc in thc number of Unit Typcs requircd, the number of <br />lnclusionary Units required shall bc rccalculated to coincide with thc final approved <br />project. In applying and calculating the fittecn (15) pcrcent rcquirement, any dccimal <br />fraction Icss than or equal to 0.50 may bc disrcgarded, and any decimal fraction greater <br />than 0.50 shall be construcd as one Unit. <br /> <br />B. Commercial, Office, and Industrial (COI) Development <br /> <br />In licu of paying the Lower Incomc Fcc as sct forth in City Ordinancc No. 1488, COI <br />development may providc affordable housing consistent with this Ordinance. As a result, <br />new COI developments arc strongly encouragcd to submit an Affordable Housing <br />Proposal as set forth in Section 17.44.100 of this ordinancc.
