<br />7. The new fireplace shall be a gas fireplace, pellet-fueled wood heater, or EPA certified <br />wood-burning appliance. The fireplace type shall be indicated on the floor plan <br />submitted for issuance of building permits. <br /> <br />8. Final inspection by the Planning Department of the structure(s) is required prior to <br />occupancy of the addition. <br /> <br />9. This design review approval for this case shall lapse within one (1) year from the date of <br />approval, April 28, 2007, unless a building permit has been issued and construction has <br />commenced and is diligently pursued toward completion, or unless an extension has been <br />approved by the City. <br /> <br />10. Site improvements and construction activities shall be limited to the hours of 8:00 a.m. to <br />5:00 p.m. Monday through Friday. All construction equipment must meet DMV noise <br />standards and shall be equipped with muffling devices. No construction activities shall <br />be allowed on Federal holidays. <br /> <br />11. This design review approval will lapse one year from the effective date of approval, <br />unless a building permit has been issued and construction has commenced and is <br />diligently pursued toward completion, or unless an extension has been approved by the <br />City. <br /> <br />12. The applicant shall pay the cost of a replacement wood fence in the Georgatos' rear yard. <br />This fence shall be a 6-foot tall redwood fence with I-foot oflattice above, for a total <br />height of7-feet. Additionally, the applicant shall split the cost of a replacement redwood <br />fence on the common rear property line with the Georgatos'. The fences shall be <br />constructed at the earliest possible time after issuance of a building permit for the <br />addition.
