<br />Ordinance No. 1939 <br />Exhibit B <br /> <br />changes are constituted in site design, grading, house design, house colors or <br />materials, fence material, fence location, landscape material, etc. <br /> <br />21. The approved house colors/materials shall be indicated on the final building <br />permit plans. Any proposed revisions to these approved colors or materials must <br />be submitted for review and approval by the Planning Director prior to <br />painting/installation. <br /> <br />22. The applicant shall prepare a Conditions, Convents and Restrictions (CC&Rs) to <br />address the maintenance of the private drive and the retention of the open space on <br />each property. A copy of the CC&Rs shall be submitted to the City for review and <br />approval. This CC&Rs shall be recorded with the parcel map and that a copy of <br />the recorded document shall be given to all property owners. <br /> <br />23. Concurrent with the recordation of a parcel map to create three single-family <br />residential parcels, the applicant shall record with the Alameda County Recorder's <br />Office the following: <br /> <br />a) annexation of areas designated for open spaces on Lot 2 and Lot 3 of this <br />development to the Urban Wildland Interface district of Tract 6400 (the <br />Preserves). The annexation document shall be approved by the City <br />Attorney prior to recording. <br /> <br />b) a wildland fire protection plan for the areas designated for open spaces on <br />Lot 2 and Lot 3 of this development. This document shall be reviewed and <br />approved by the Fire Marshal and the Planning Director prior to recording. <br /> <br />c) designation of the area identified as Parcel A of Lot 3 for open space. The <br />specific language of open space designation shall be review and approved <br />by the City Attorney prior to recording. <br /> <br />24. All retaining walls visible from Dublin Canyon Road shall be finished with natural <br />materials such as stone or wood. <br /> <br />25. The applicant shall disclose to the future owner of Lot 3 that prior to the issuance <br />of a building permit, the property owner shall submit the following: <br /> <br />a) a conformation letter from Nicholas Engineering, Inc. stating that the <br />recommendations included in the original geotechnical report prepared in <br />1999 are applicable for the proposed development; and, <br /> <br />b) a grading and drainage plan that thoroughly evaluates the high waterCOntent on the subject site. <br /> <br />5 <br />
