<br />These measures shall be shown on the building permit plan set submitted to the <br />Planning Director for review and approval before issuance of the first building <br />permit. The project developer shall provide to the future homebuyers the neces- <br />sary information delineating the means by which photovoltaic panels can be ap- <br />plied to the roofs of the structures covered by this approval. This information <br />shall be submitted to the Director of Planning for review and approval prior to oc- <br />cupancy of the first unit. <br /> <br />Tentative/Final Subdivision Map Requirements: <br /> <br />43. With the tentative subdivision map, the project developer shall set forth the com- <br />mon open space/maintenance areas of the proposed development and maintenance <br />responsibilities. The project developer shall record CC&R's at the time of recor- <br />dation of the final subdivision map, which shall create a homeowners association <br />for the development. The CC&R's shall be subject to the review and approval of <br />the City Attorney prior to recordation of the final map, The property owners asso- <br />ciation shall be responsible for the maintenance of all private utilities, wildland <br />fire and buffer areas, bio-retention ponds, landscape buffer areas along the south <br />side of Lots 1 through 5 and the north side of Lots 6 through 8, and other common <br />areas/facilities on the site. The City shall be granted the rights and remedies of the <br />association, but not the obligation, to enforce the maintenance responsibilities of <br />the property owners association. <br /> <br />44. The project developer shall show with the tentative subdivision map application <br />the building setback lines conditioned by this approval superimposed on the lots. <br /> <br />45. The CC&R's for the project shall prohibit the parking of boats, campers, and trail- <br />ers on Lots 1 through 8. <br /> <br />46. Prior to recordation of the final subdivision map, all modifications required to the <br />design guidelines through conditions of approval shall be combined into a single <br />comprehensive document. This document shall be submitted to the Planning Di- <br />rector for review and approval prior to publication. The project developer or its <br />successor in interest shall disclose the design guidelines to the lot buyers prior to <br />close of escrow, and shall provide them with copies of the guidelines. <br /> <br />47. The project developer shall prepare maintenance agreements for the shared drive- <br />way including the culvertslbridges. The agreements shall be submitted to the City <br />Attorney for review and approval before City Council approval of the first final <br />subdivision map for this development and shall be recorded over the project site <br />by separate instrument. <br /> <br />SR 06:242 <br />Page 12 of24 <br />
