<br />48. The recorded deed of sale for all lots covered by this PUD Development Plan ap- <br />proval shall include the following: <br /> <br />a. A disclosure stating that the City of Pleasanton intends to develop and op- <br />erate the Alviso Adobe Park, a City park, and that the buyer recognizes that <br />the activities that take place in the Alviso Adobe Park may result in noise, <br />odors, dust, traffic or other conditions that may affect the lots covered by <br />this PUD Development Plan, <br /> <br />b. A disclosure stating that the City of Pleasanton owns the open space area <br />surrounding Lots 1 through 8, that the open space area can be used by the <br />public, and that the buyer recognizes that the activities that take place in the <br />open space area may result in noise, odors, dust, or other conditions that <br />may affect the lots covered by this PUD Development Plan, <br /> <br />c, A disclosure indicating the presence of the subdrains and cleanouts and that <br />it is the responsibility of the homeowner to relocate the subdrains if en- <br />countered during the excavation of a pool or other subsurface structure. <br /> <br />d. The following statement, signed by the future homeowner stating, that: <br /> <br />"You are hereby advised that this property is surrounded by land <br />zoned and/or used for the day and night-time activity relating to live- <br />stock grazing and the keeping of livestock. Some of the impacts as- <br />sociated with this use include, but are not limited to, noise, odor, <br />dust, chemicals, refuse, waste, unsightliness, use of agricultural <br />equipment, and traffic. Permitted agricultural pursuits conducted in <br />accordance with good practice and maintenance are not deemed by <br />the City of Pleasant on to be a nuisance." <br /> <br />Wording for these clauses and/or disclosures shall be submitted to the City Attor- <br />ney for review and approval before City Council approval of the first final subdi- <br />vision map for this development and shall be recorded over the project site by <br />separate instrument. <br /> <br />49. With recordation of the final map, the project developer shall abandon access <br />rights to Old Foothill Road, <br /> <br />Building and Site Design Requirements: <br /> <br />SO. The project developer shall provide automatic opening sectional roll-up garage <br />doors throughout the project, as approved by the Chief Building Official and the <br />Planning Director. <br /> <br />SR 06:242 <br />Page 13 of24 <br />
