<br />25. With the first construction phase, the project developer shall construct the public <br />infrastructure including the street and cul-de-sac, mass grading for the lots, bio- <br />retention pond/swales, perimeter landscaping in the open space area, the shared <br />access driveways, and all entry landscaping along Foothill Road, Old Foothill <br />Road, and Austin Place. The applicant shall work with Parks and Community <br />Services staff to design a coordinated entry landscape plan for the development <br />and the Alviso Adobe Park, and shall install such landscaping. <br /> <br />26. With the application for the tentative subdivision map, the project developer shall <br />submit the following: <br /> <br />a. An updated tree analysis for the eight-lot portion of this development; and, <br />b. A mitigation plan showing the location of protective fencing for the trees, <br />swales, seeps, etc. <br /> <br />These items shall be subject to final review and approval with the Planning Com- <br />mission's action on the tentative subdivision map. <br /> <br />27. Thirty days before grading begins, the project developer shall survey the eight-lot <br />portion of this development for nesting raptors and burrowing owls. If present, the <br />project developer shall submit a mitigation plan prepared by a licensed biologist <br />for the review and approval by the Planning Director. The project developer shall <br />implement the mitigation plan to the satisfaction of the Planning Director, <br /> <br />28. The project developer shall complete all of the on-site improvements at one time, <br />including all improvements around future building pads. <br /> <br />29. After the subdivision improvements are completed to the satisfaction of the Plan- <br />ning Director and the City Engineer, the project developer shall install the refores- <br />tation trees and interim irrigation system in the areas surrounding the eight-lot por- <br />tion of this development. The project developer shall maintain the tree planting <br />and irrigation system for a time-period no less than three years where the mainte- <br />nance shall then revert to the homeowners association created for this develop- <br />ment. <br /> <br />30. If the applicant commences grading for the project prior to the City's Alviso <br />Adobe Park Project, he shall work with the Dircctor of Parks and Community Ser- <br />vices to identify potential improvements that could be done to the Park. Any work <br />performed by the applicant for strictly Park improvements will be subject to a re- <br />imbursement agreement. <br /> <br />SR 06:242 <br />Page 9 of24 <br />
