Resolution No. 92-102 Page Two WHEREAS, the cost to each property owner is proposed to be calculated based on five categories of land use, estimated benefits, and parcel size as set forth in the city staff report prepared with this resolution by the Public Works Department; and WHEREAS, a noticed public hearing was held for purposes of considering the adoption of this Resolution and the proposed Storm Water Discharge Fee; and WHEREAS, the City Council finds as follows: (a) after review of the city staff report and all testimony received at the public hearing it finds that each and every portion of said report is sufficient; (b) the fees assessed to each parcel in the City of Pleasanton shall be used to provide funds to implement the city's share of the Alameda County Urban Runoff Clean Water Program; (c) the fees charged and the amount to be raised by the assessment of the Storm Water Discharge Fee do not exceed the estimated total cost of the Program and related expenses described in this report; and (d) the cost of the Program and the method of allocating the cost among all the properties in the city has been stated in the staff report; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The following method shall be used to calculate the Storm Water Discharge Fee as follows: LAND USE FEE COST Commercial & Industrial $28 base rate (.25 acre), $112/acre Institutions & Apartments $21 base rate (.25 acre), $84 acre Single Family Residential & Small Multiples $14 base rate, for that area over .25 acres, use rate for Vacant Land Use for Farms and Crops Vacant-Land Use For Farms, Crops and Irrigation $7 base rate, portion over .25 acre the rate is $.70 per acre
