WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-102 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF PTmASANTONAPPROVING AND ESTABLISHING A <br />STORM WATER DISCHARGE FEE <br /> <br />the 1987 Amendments to the Clean Water Act, as <br />implemented by the Environmental Protection Agency <br />regulations adopted November 16, 1990, make necessary <br />the adoption of plans and programs for storm water <br />management meeting specified criteria; and <br /> <br />Section 402(p) of the Clean Water Act, as amended by <br />the Water Quality Act of 1987, requires that all large <br />and medium sized incorporated municipalities must: <br /> <br />(a) <br /> <br />"effectively" prohibit non-stormwater discharges <br />into the storm sewer; and <br /> <br />(b) <br /> <br />require controls to reduce the discharge of <br />pollutants from the storm water systems to waters <br />of the United States to the maximum extent <br />practicable; and <br /> <br />in order to implement the federal regulatory <br />requirements described above, the City of Pleasanton <br />has entered into an "Agreement to Implement the Alameda <br />County Urban Runoff Clean Water Program" dated July, <br />1991; and <br /> <br />on October 16, 1991 the California Regional Water <br />Quality Control Board, San Francisco Bay Region issued <br />Order No. 91-146, NPDES Permit No. Ca. 0029831, <br />regulating, inter alia, storm water discharges by the <br />City of Pleasanton; and <br /> <br />the major objective of the Alameda County Urban Runoff <br />Clean Water Program (hereafter "Program") is to protect <br />the quality of water and life in San Francisco Bay and <br />tributary streams in Alameda County from potentially <br />adverse effects of storm water pollution; and <br /> <br />funding for this federally mandated program was not <br />provided by federal, state, regional or other funding <br />source and each city in Alameda County is responsible <br />for funding its portion of the Program and NPDES permit <br />cost; and <br /> <br />storm water drainage system benefits all properties in <br />the City of Pleasanton; and <br /> <br /> <br />
