This information shall be submitted to the Director of Planning for <br />review and approval prior to occupancy of the first unit. <br /> <br />Disclosures <br /> <br />36. The recorded deed of sale for all lots covered by this PUD Development Plan approval <br />shaH include the following: <br /> <br />a. A clause stating the existence of the Zone 7 lake located on the east side of Martin <br />A venue is a reclaimed Kaiser quarry pit. <br /> <br />b. A clause indicating the close proximity of the Livermore Municipal Airport; the <br />possible impacts to homes due to aircraft overflights; a warning that the noise gen- <br />erated from the Livermore Airport is a mix of business jet and small aircraft opera- <br />tions; that the Livermore Airport operates 24 hours per day, 365 days per year; and <br />that the Livermore Airport has proposed an expansion of the airport. <br /> <br />The project developer shall submit the wording for this notice to the City Attorney for <br />review and approval before recordation of the final subdivision map. <br /> <br />Tentative/Final Subdivision Map Requirements: <br /> <br />37. The project developer shall record CC&R's at the time of recordation of the final subdivi- <br />sion map, which shall create a property owners association or as maintenance association <br />for this development. The property owners/maintenance association shall include Lots 4 <br />through 27. The CC&R's shall be subject to the review and approval of the City Attorney <br />prior to recordation of the final subdivision map. The property owners/maintenance as- <br />sociation shall be responsible for the maintenance of the bio-retention areas adjoining <br />Street "A" and the public right-of-way landscaping between the sidewalk and curb facing <br />Cameron Avenue. The City shall be granted the rights and remedies of the association, <br />but not the obligation, to enforce the maintenance responsibilities of the property own- <br />ers/maintenance association. <br /> <br />38. The project developer shall prepare development standards for inclusion within the <br />CC&R's for decks, patio covers, pools, and other accessory structures for review and ap- <br />proval by the Planning Director prior to approval of a final subdivision map. The stan- <br />dards shaH conform to the development stated in these conditions. <br /> <br />39. The CC&R's for the project shall prohibit the parking of boats, campers, and trailers on <br />site. <br /> <br />40. Any proposed phasing of this development shaH be depicted on the tentative tract map <br />and shall include narrative explaining the proposed phasing.
