<br />EXHIBIT "B" <br />Recommended Conditions of Approval <br />Case PV-153/PADR-1536 <br />4558 Second Street <br /> <br />1. The proposed additions shall conform substantially to the site plan, floor plan, <br />elevations, and related materials, Exhibit A (dated "Received" May 1, 2006), <br />on file with the Planning Department, except as modified by these conditions. <br />Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director if found to be in substantial conformance with the approved <br />exhibits. <br /> <br />2. The variance and design review approvals will lapse one year from the date of <br />approval, unless prior to the expiration, construction has commenced and <br />diligently pursued toward completion, or an extension has been approved by <br />the City. <br /> <br />3. The applicants shall pay any and all fees to which the project may be subject <br />prior to issuance of a building permit. The type and amount of the fees shalI be <br />those in effect at the time the permit is issued. <br /> <br />4. All appropriate City permits shall be obtained prior to the construction of the <br />additions. <br /> <br />5. Construction activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., <br />Monday through Friday. No construction shall be allowed on Federal <br />Holidays. If future cornplaints are received regarding the construction hours, <br />the Planning Director may modify the construction hours. The Planning <br />Director may allow earlier "start-times" for specific construction activities <br />(e.g., concrete-foundation/floor-pouring) or due to weather. All construction <br />equipment must meet DMV noise standards and shall be equipped with <br />muffling devices. <br /> <br />6. The plan check materials will be accepted only after the completion of the <br />variance and design review procedures' IS-day appeal period (15 days from the <br />date of the approval letter), unless the applicants submit a signed statement <br />acknowledging that the plan check fees may be forfeited in the event that the <br />approval is overturned or the design is significantly changed as the result of an <br />appeal. In no case will a building permit be issued prior to the expiration of <br />the 15-dav appeal period. <br />
