the construction costs for the I-680/West Las Positas Boulevard lnterchan ge, if <br />required, or alternative traffic mitigation improvements) selected by the City <br />Council, depending on the manner of creation of-the funding mechanisrrx; <br />h. the owner retains the right to protest that the allocation of costs among various <br />properties is inequitable under the above-mentioned funding mechanisms, and, <br />c. ixz the event the assessment machanisn~ appears to ixnpo se economically infeasible <br />levels of costs upon the site, the City agrees to explore alternative financing <br />nzethods_ <br />This agreement shall apply to any alternate City program designed to mitigate long-tenrx <br />traffic levels-of-service on north Pleasanton freeway interchanges, stre cts, and/or <br />intersections with without the I-680/West 7.as Positas Interchange. Additionally, the <br />project developer/property owner acknowledges that: <br />a_ The City of Pleasanton does not guarantee that existing Level-of-Service (LOSS <br />standards will be maintained in perpetuity and that no guarantee is xr~ade by the <br />City that it will be responsible for keeping north Pleasanton streets, intersections, <br />and freeway entrance/exit ramps at LOS 1J or better. <br />b. 7f required by the City, the project developer shall implement a proactive <br />Transportation Systems Management program or other measures required by the <br />City Council to mitigate this project's anticipated traffic impacts. <br />17. The project developer shall eli'ectively screen born view all ducts, n~xeters, air <br />conditioning cquipmcnt, and any other mechanical equipment, whether on the structure, <br />on the ground, or on the roof, with materials architecturally co mpatiblc with the main <br />structure. Screening details shall be shown on the plans subtYxitted for issuance of <br />building permits, the adequacy of which shall be determined by the Planning Director. <br />All required screening shall be provided prior to occupancy. <br />1 8. Tlxe topmost elevation of all roof-mounted mechanical equipment shall be at or below the <br />elevation of the roof-mounted screen wall unless aline-of site analysis is provided which <br />shows that all portions of said cquipmcnt will not be seen from the opposite side of <br />Chabot Drivc_ <br />19. All mechanical equipment shall be constructed in. such a manner that noise etrxanating <br />from it will not be perceptible beyond the property plane of the subject property. <br />20. All trash and refuse shall be contained completely within the trash enclosure. The <br />materials, color, and detailing of the enclosure walls shall xr~atch the building design, and <br />the gates shall be corrugated meta] or solid wood. "The location and design of the <br />enclosures shall be shown on the plans submitted for issuance of building permits and <br />shall be subject to the approval of the Planning Director. Trash containers shall be stored <br />within the enclosure at all tin-xcs, except when being unloaded. <br />
