<br />noise here would effect existing residents in the Vineyard Corridor as well as those under <br />construction which could be occupied before the water tank is completed. <br /> <br />Recommendation: Construction for PUD-54 and PUD-520 can only take place <br />Monday through Friday, excluding holidays <br /> <br />Staff agrees and recommends Condition No. 33 be revised as follows: <br /> <br />33. All construction activitics shall be limited to the hours of 8:00 a.m. <br />to 5:00 p.m., Monday through Saturday Friday. In addition, no <br />construction shall bc allowcd on Fcdcral Holidays. The Planning Director <br />may allow earlier "start-times" for specific construction activities (e.g., <br />conercte-foundation/Iloor-pouring), ifit can be demonstrated to thc <br />satisfaction of the Planning Dircctor that the construction and construction <br />traffic noise will not affect nearby residents. All construction equipment <br />must mcet Department of Motor Vehicles (DMV) noise standards and <br />shall bc equippcd with muffling devices. <br /> <br />Issue 5 - BuildinQ HeiQhts <br />The Staff Report asks for exceptions of building height for lots over 540 feet. The Specific Plan <br />on page 25 states that "Primary buildings located on Lot 17 and on existing elevations <br />exceeding 540 feet shall be limited to 25 feet in height and one story". It would be in conflict <br />of the Specific Plan, and require a Specific Plan change, to allow homes over 25 feet in height <br />at this elevation. The Specific Plan states, "Minor variations may be permitted." Allowing 5 <br />out of the 7 homes to be over 25 feet is not a minor variation. If it can be found that the house <br />heights can be over 25 feet while being completely screened from off-site (including existing <br />residents in the Vineyard Corridor), this finding could possibly be made but there is not enough <br />information at this time to make this finding. <br /> <br />Staff agrees and proposes to add your recommended Condition of Approval as a new condition, <br />as modified: <br /> <br />Recommended language: "Although the Specific Plan limits building heights on <br />existing elevations exceeding 540 feet for 25 feet in height and one story, building <br />heights may be allowed to exceed 25 feet, but no greater than 27 feet and 9f two- <br />story on a case-by-case basis if the finding can be made that the additional height <br />will not create an additional visual impact to offsite locations and adjacent <br />neighbors over a structure 25 feet or less. <br /> <br />Issue 7 - DrainaQe <br />Since my property is downhill from this development, I want to know what the drainage plan is <br />so that these Lots do not drain onto my property. A sentence should be added to condition 14 <br />that requires that lots do not train onto the adjacent Brozosky property (similar to the condition <br />for Lot 1 draining onto the adjacent Roberts property). <br /> <br />4 <br />
