<br />Staff recommends Condition No. 9 be revised as follows: <br /> <br />9. Prior to recordation of the final map, thc applicant shall grant to <br />the City an easemcnten Lot 6 for an emergency vchiclc acccss (EV ^) <br />road on the Reznick property. The exact location of the EVA shall be <br />shown on the tentative map and the applicant shall bc rcsponsiblc for <br />construction of the EVA on his property. The applicant shall alss enter <br />into [111 agreement with the City and depositadeqllate fUflds .....ith the City <br />to construct that portion within the project bBlmdary. If the EV:\ is not <br />constructed, the funds will be returned te the applicant or his/her heirs. <br />The agreement shall be as revised [lnd appro',ed by the City ."Usme)' ami <br />the amount te be defJssi~all be determined by the City Engineer. <br /> <br />Issue 2 - Sports Courts <br />PUD-54 condition 18(r) should state that sport courts are not allowed due to visual and noise <br />impacts. Lighted facilities are not appropriate in hillside residential in this location. Because of <br />the location of this development, any sports court would create echoing to all adjacent <br />properties because of the topology and would be a noise impact. There would be no way to <br />buffer the noise to the outside receptors. <br /> <br />Recommendation: No sports courts, lighted or otherwise, shall be located in the hillside <br />residential lots. <br /> <br />Staff concurs and provides a new condition of approval regarding disallowing sport courts: <br /> <br />Sport courts shall not be allowed on any lot in the development. <br /> <br />Issue 3 - Disclosures <br />Since this property is adjacent to my property, lot 24, the same disclosures about pigs should be <br />present for this project as was required for lot 18 because of the proximity to an existing pig <br />operation. A disclosure should be added to state that: <br /> <br />Recommendation: "Animal husbandry activities, including pig farming, of nearby <br />property owners in the Specific Plan area shall be prominently displayed in the <br />sales office for this development and within the CCR's" <br /> <br />Staff concurs and has added this to the disclosures. <br /> <br />Issue 4 - Hours of Construction <br />PUD-54 condition 33 has the hours of construction Monday through Saturday. To be consistent <br />with all other previously issued PUD's in this Plan area, the construction hours shall by Monday <br />through Friday. The only exceptions made to the Monday through Friday restrictions to date <br />have been for Lots 18 and 19 for the construction of New Vineyard Avenue although the rest of <br />the construction on those properties is still Monday through Friday. <br /> <br />PDR-520 has the same issue of construction time as condition 19. This condition should also <br />be changed to Monday through Friday. The location of this development as well as the Reznick <br />homes are in the hills and the noise travels far since there is no way to buffer the noise. The <br /> <br />3 <br />
