<br />Resolution No. 06-041 <br />Page 2 <br /> <br />WHEREAS, California Elections Code section 9222 permits the City Council to submit to the <br />voters a proposition for the repeal, amendment or enactment of an ordinance; and <br /> <br />WHEREAS, the City Council has reviewed and considered the BERNAL PROPERTY PHASE <br />II LAND USE PLAN INITIA TIYE ordinance attached to this Resolution as <br />Exhibit I; and <br /> <br />WHEREAS, the BERNAL PROPERTY PHASE II LAND USE PLAN INITIA TIYE ordinance <br />is a portion of the Bernal Property Phase II Specific Plan for which an <br />Environmental Impact Report has been prepared, adopted and certified as <br />complete by the City of Pleasanton on May 16, 2006, and therefore no additional <br />environmental review is required to place this initiative measure on the ballot; and <br /> <br />WHEREAS, California Elections Code section 9282 specifies that the legislative body, or any <br />member or members of the legislative body authorized by that body, may file a <br />written argument for any City measure; and <br /> <br />WHEREAS, California Elections Code section 9285 sets forth the procedures for rebuttal <br />arguments; and <br /> <br />WHEREAS, California Elections Code section 9280 specifies that the City Council may direct <br />the City Clerk to transmit a copy of the initiative measure to the City Attorney to <br />prepare an impartial analysis thereof. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOL YES <br />AS FOLLOWS: <br /> <br />Section I: That the City Council sponsored BERNAL PROPERTY PHASE II LAND USE <br />PLAN INITIA TIYE ordinance, attached to this Resolution as Exhibit I, be placed <br />on the November 7,2006 General Election ballot, with the initiative measure to be <br />designated by letter by the Alameda County Registrar. <br /> <br />Section 2: The ballot language for the initiative measure shall be as follows: <br /> <br />Shall the Bernal Property Phase II Land Use Plan, <br />comprised of the "grand park" design concept, <br />as adopted by the City Council, be ratified? <br /> <br />Section 3: The City Council authorizes a direct argument in favor of the initiative measure to <br />be written by Council members Cindy McGovern and Jerry Thome, considered by <br />the entire City Council at its regular meeting on June 20, 2006, and signed by all <br />five members of the City Council. <br />
