<br />will be set back approximately 40-feet from the north side of property owned by Ron Lloyd. <br />Regarding the EVA, the Vineyard Avenue Corridor Specific Plan states: <br /> <br />"If the housing development on Lot 3 (Hatsushi) precedes that planned for Lots 1 <br />and 2, then vehicular access to Lot 3 may be temporarily provided by way of an <br />emergency vehicle access (EVA) road connection to Montevino Drive until such <br />time as the public street (cul-de-sac) connection to Clara Lane can be accom- <br />plished. The southern edge of the EVA where it connects to Montevino Drive <br />shall be located 4S-feet north of the north side property line of the parcel located at <br />8S4 Montevino Drive (Lloyd property). As soon as the public street connection <br />from Lot 3 to Clara Lane can be accomplished, the EVA shall be closed to all traf- <br />fic except for emergency vehicles, pedestrians, and bicycles. The City should give <br />strong consideration to negotiating a sale/transfer of the remainder of the triangu- <br />lar-shaped right-of-way in which the EVA is to be partially located to the owner of <br />the lot on 8S4 Montevino Drive on the south side and the owner of Lot 3 on the <br />north side." <br /> <br />Therefore, as allowed by the Vineyard Avenue Corridor Specific Plan, the Hatsushis request us- <br />ing the EVA for construction access and project access until the final street connections are <br />completed to Clara Lane or Vineyard Avenue. <br /> <br />However, the applicants' proposal has met with neighborhood opposition. The attached emails <br />from Darryl and Judy Alexander, Ed and Sharon Nowak, Gopesh Kumar, Ron Cote, Ron Lloyd, <br />and Scott Summerfield state their concerns and opposition with the EVA's use for construc- <br />tion/domestic traffic and with its alignment; request that the EVA be restricted to only emer- <br />gency vehicles; and require the applicants complete the connection to Vineyard Avenue or Clara <br />lane with the first construction phase. Their opposition is based on existing traffic problems be- <br />ing experienced on Montevino Drive including high vehicle speeds, difficulty with backing-out <br />onto Montevino Drive, vehicular noise, construction traffic noise, etc. Opposition to the EVA's <br />use for construction/domestic traffic extends back to the preparation of the Specific <br />PlanlEnvironmental Impact report. Attached is a copy of the petitions signed by owners during <br />that time stating their opposition. <br /> <br />Staff investigated the means whereby the Hatsushis could complete Clara Lane to Road "A" <br />with the proposed development's first construction phase. All construction and domestic traffic <br />for Lots 10 through 13 would then use Road "A" to Clara Lane to Vineyard Avenue. The EVA <br />would be used by emergency vehicles only. Staff, the Hatsushis and their consultants, and Mi- <br />chael Aminian, owner of the property adjoining Lot 10 that will provide the required right-of- <br />way to complete Clara Lane, have met to discuss right-of-way acquisition, shared construction <br />costs, and construction timing. Mr. Aminian agreed to work with staff and the Hatsushis to <br />dedicate right-of-way and share design/construction costs to complete Clara Lane before devel- <br />opment of his property. (Mr. Aminian will be submitting his development plan proposal to sub- <br />divide his property into three lots for two new homes later this year.)
