<br />consolidate this municipal election with the November 7th General Election; decide if the City <br />Council would like to author and sign an argument in favor of the initiative measure, and if so, <br />select a two Council members to write the argument language; consider whether rebuttal <br />arguments will be permitted; set deadlines to submit the direct and rebuttal arguments; and with <br />regard to general election procedures, establish policies for Candidate Statements and other <br />election materials, as well as tie vote procedures. <br /> <br />Honorable Mayor and Members ofthe City Council: <br /> <br />BACKGROUND <br /> <br />Initiative Measure to Approve Bernal Property Phase II Land Use Plan <br /> <br />The Bernal Property (Phase I) Specific Plan, adopted by the City in August 2000, included <br />as a guideline that the Pleasanton voters approve the land uses and facilities within the Phase II <br />area of the Bernal Property. (See Bernal (Phase I) Specific Plan Land Use Element Guideline <br />1.3.) This requirement for voter approval was reaffirmed and readopted in the Bernal Property <br />Right to Vote Initiative (Measure X) in November 2004. <br /> <br />With the City Council's approval of the Bernal Property Phase II Specific Plan on May <br />16,2006, Measure X now requires that the City receive voter approval of the land uses and <br />facilities within the Phase II area prior to implementation of the Phase II Specific Plan. <br /> <br />The Phase II area generally consists of the 318-acre public land portion of the larger 516- <br />acre Bernal Property. Under the Bernal Property (Phase I) Specific Plan, certain acreage (and <br />Sub-areas) within the Phase II Planning Area have already been developed or the land uses are <br />not subject to voter approval under Measure X: the two acre Fire Station site (Sub-Area 4); the <br />11.1 acre Hearst Elementary School site (Sub-area 8); and the 50 acre Bernal Community Park <br />(Sub-area 2). [The City Council on May 16,2006 approved a Master Plan for this Park.] <br />Accordingly, these Phase I community facilities, although shown within the Phase II planning <br />area, are not subject to the voter approval requirement under Measure X. <br /> <br />While the Bernal Community Park is not subject to Measure X's voter approval <br />requirement, the City Council may still decide to include the Bernal Community Park Master <br />Plan as part of the City-sponsored initiative measure. Staff, however, does not recommend the <br />inclusion of the Park Master Plan into the City-sponsored initiative measure because: (a) there <br />has already been extensive community participation in the development of the Master Plan <br />involving the Bernal Community Park Task Force, Youth Master Plan Implementation <br />Committee, Civic Arts Commission, Youth Commission, Parks and Recreation Commission, <br />Planning Commission and City Council; (b) the Master Plan includes specific detail about the <br />location of facilities in the Site Plan and, if the Master Plan is included in the initiative measure, <br />subsequent changes to the Site Plan could also require voter approval; and (c) implementation of <br />the Master Plan, currently including two formal play baseball fields, one informal play baseball <br /> <br />SR 06:158 <br />Page 2 of? <br />
