68 pLEASANTONc City Council Staff Report June 6, 2006 Planning Department Law Department City Clerk SUBJECT RESOLUTION PLACING ON THE NOVEMBER 7,2006 BALLOT AN INITIATIVE MEASURE FOR THE APPROVAL OF THE BERNAL PROPERTY PHASE II LAND USE PLAN; DETERMINATION REGARDING BALLOT ARGUMENTS FOR INITIATIVE; AND RESOLUTION REQUESTING CONSOLIDATION WITH STATEWIDE GENERAL ELECTION AND ESTABLISHING VARIOUS ELECTION PROCEDURES STAFF RECOMMENDATION: 1. Select ballot language Option 1 and adopt the attached resolution (Exhibit A) placing on the November 7, 2006 ballot an initiative measure for approval of the Bernal Property Phase II Land Use Plan. 2. Select two Council members to author the direct argument in favor of the initiative measure for future consideration of signature by all five Council members, allow rebuttal arguments, and establish deadlines for submittal of the arguments. 3. Adopt attached resolution (Exhibit C) to consolidate the municipal election with the statewide general election and establish related election procedures. SUMMARY The Bernal Property Right to Vote Initiative (Measure X), adopted by the Pleasanton voters in November 2004, requires that the City receive voter approval for the Bernal Property Phase II Land Use Plan prior to implementation. With the City Council's recent approval of the Bernal Property Phase II Specific Plan and the Bernal Community Park Master Plan, the November 7, 2006 General Election is the next election date on which a City-sponsored initiative measure can be considered by the voters. In order for this to occur, the City Council must call for an election to allow voters to consider a City-sponsored initiative measure; determine what elements to include in the initiative measure; SR 06:158 Page 1 of?
