<br />field, children's play area, and parking lot in "Phase One", would need to be stopped until the <br />initiative measure is approved by the voters. <br /> <br />For these reasons, staff recommends that the initiative measure focus on the Phase II <br />Land Use Plan as required by Measure X, and not include the Bernal Community Park Master <br />Plan. <br /> <br />Ballot Language. An initiative measure for voter approval of the subject Bernal Property <br />Phase II Specific Plan land uses is recommended to be placed on the November 7, 2006 ballot. <br />Staff suggests ballot language options as follows: <br /> <br />Option I - Shall the Bernal Property Phase II Land Use Plan, as adopted <br />by the City Council, be ratified? <br /> <br />** or ** <br /> <br />Option 2 - Shall the Bernal Property Phase II Specific Plan Land Use <br />Plan, comprised of the "grand park" design concept, and <br />Sub-Area Land Use Plan and related Potentially Permitted <br />Land Uses by Sub-area, be adopted? <br /> <br />** or ** <br /> <br />Option 3 - Shall the Land Use Plan and Potentially Permitted Land Uses <br />by Sub-area for the Bernal Property Phase II Specific Plan be <br />. adopted? <br /> <br />These ballot language options are only suggestions. The Council may decide to phrase the <br />ballot question in another manner, subject to a 75 word limit. <br /> <br />Ballot Arguments for Initiative Measure <br /> <br />The Elections Code provides that the City Council, any Council member, any registered <br />voter, or any combination of voters may file a written argument in favor of or against the <br />initiative measure. Arguments may be signed by up to five persons and are distributed with the <br />sample ballot. If more than one argument is received, the Elections Code sets the priority in <br />which arguments are selected for publication, as follows: (i) the Council, or any member(s) ofthe <br />Council authorized by the Council; (ii) the sponsor of the measure; (iii) association of citizens; <br />and (iv) individual voters. <br /> <br />Council should decide whether it wishes to write an argument in favor of the initiative <br />measure, which Council member( s) will draft the language of the argument, and which Council <br />member(s) will sign the argument. To comply with State open meeting laws (e.g. the Brown <br />Act), only one or two Council members should be involved in the drafting of the argument <br /> <br />SR06:l58 <br />Page 3 of7 <br />
