<br />facility. The East County Area Plan designates the land where the composting facility is <br />proposed as "Water Management Lands." Unlike the zoning for the site, which clearly <br />authorizes composting facilities with a conditional use permit, the "Water Management Lands" <br />designation does not specifically state that composting is allowed. In the definitions section of <br />Table I of the East County Area Plan, the term "composting" falls under the definition of "solid <br />waste facilities" but the Water Management Lands designation also does not specifically state <br />that "solid waste facilities" are allowed on property so designated. <br /> <br />Instead, the Water Management Lands designation states that "recycling uses reqUlrmg <br />proximity to quarries" are allowed. Unfortunately, the term "recycling" is not defined in the <br />East County Area Plan or the County Zoning ordinance. As a result, parties on both sides of the <br />issue are left to debate whether the composting facility is a recycling use requiring proximity to <br />a quarry. <br /> <br />The Council is concerned that the Alameda County Waste Management Authority may be <br />interpreting the uses allowed on lands designated for "Water Management Lands" too broadly, <br />and contrary to Measure D. Because this could have implications for how Measure D is applied <br />for future projects in unincorporated areas that directly affect the City of Pleasant on, the Council <br />has asked that staff draft a letter which raises its concerns to the Alameda County Waste <br />Management Authority. That letter is attached to this report. <br /> <br />FISCAL IMPACT <br /> <br />No impact. <br /> <br />STAFF RECOMMENDATION <br /> <br />Staff recommends that the Council authorize the Mayor to send the attached letter to the <br />Alameda County Waste Management Authority.
