<br /> <br />- <br /> <br />pLEASANTON@ <br /> <br />May 16, 2006 <br /> <br />Brian Mathews, Program Manager <br />Alameda County Waste Management Authority <br />777 Davis Street, Suite 100 <br />San Leandro, CA 94577 <br /> <br />Re: Measure D Concerns Related to Proposed Composting Facility in Sunol <br /> <br />Dear Mr. Mathews: <br /> <br />I write on behalf of the City Council of the City of Pleasanton with regards to the composting facility that is <br />being proposed in Sunol, an unincorporated area of Alameda County. <br /> <br />When the City provided comments on the Draft Environmental Impact Report (DEIR) for this project, it <br />supported the general concept ofa composting facility. (See attached letter.) The City, however, also <br />voiced its concerns as to how the project related to Measure D---the "Save Agriculture and Open Space <br />Lands" initiative approved by the voters in 2000. In reviewing the materials further, including the <br />Authority's comment and response to the City's letter as well as its responses to others' letters, the City <br />remains concerned about whether this project complies with Measure D. <br /> <br />The land where the proposed composting facility will be located is zoned "Agricultural" and composting is <br />allowed in this zoning district with the issuance of a conditional use permit. <br /> <br />While the County's zoning ordinance clearly allows composting facilities at the proposed site, the General <br />Plan is not as clear. The proposed site falls under the "Water Management Lands" designation within the <br />East County Area Plan. Unlike the zoning for the site, the East County Area Plan's designation does not <br />specifically state that "composting" is allowed. <br /> <br />Although the definitions section of Table I of the East County Area Plan, places the term "composting" <br />under the definition of "solid waste facilities", the Water Management Lands designation does not <br />specifically state that "solid waste facilities" are allowed. Instead, the Water Management Lands <br />designation states that "recycling uses requiring proximity to quarries" are allowed.
