from those two Member Agencies would vote to participate or not <br />participate in such a Project depending on the vote of the <br />electorate in each Member~s jurisdiction; and <br /> <br /> WHEREAS, the Board would also intend that DSRSD not be <br />required to submit the Project to the voters within DSRSD but <br />that the LAVWMA Directors from that Member Agency would vote to <br />participate in such a Project if a majority of the DSRSD Board so <br />approved; and <br /> <br /> WHEREAS, the Board also wishes to provide that if this <br />Project is approved by one or more Member Agencies, that all the <br />Member Agencies must unanimously agree prior to such Project <br />serving any unincorporated area of Alameda County which is south <br />of Interstate 580 or in the North Livermore Valley; and <br /> <br /> WHEREAS, to accomplish the sponsorship of such a Project as <br />provided above, the Board must amend the JPA. <br /> <br /> NOW, THEREFORE, the parties agree to modify further the JPA <br />as follows: <br /> <br /> 1. A new paragraph is hereby added to the Agreement to <br />read as follows: <br /> <br /> "XXIII. ProleG~ Not to Exceed Additional Capacity of 12.7 <br />M~lliOn Gallons [Averaae Dry Weather Flow ("ADWF")I Per Day. <br />Notwithstanding any other provisions in this Agreement to the <br />contrary, with respect to a Project which, if approved, would <br />increase sewage capacity in an amount not to exceed 12.7 million <br />gallons (ADWF) per day, the following provisions shall apply. <br /> <br /> - 2 - <br /> <br /> <br />
