BBCOND MODXFICXTXON TO L3VleM3 <br /> · OINT EXERCISE OF P~S 3~RB~2~NT <br /> <br /> This second modification agreement is entered into this <br /> <br /> day of , 1993, by and between the <br /> <br />CITIES OF LIVERMORE and PLEASANTON and the DUBLIN SaN RAMON <br />SERVICES DISTRICT. <br /> <br /> WHEREAS, on June 18, 1974, the parties hereto executed a <br />Joint Powers Agreement ("JPA") creating the LIVERMORE AMADOR <br />VALLEY WATER MANAGEMENT AGENCY ("LAVWMA") for the purpose of <br />establishing a water quality management program pursuant to <br />Resolution 71-3 of the Regional Water Quality Control Board, San <br />Francisco Bay Region; and <br /> <br />WHEREAS, the JPA was first modified on May 31, 1977; and <br />WHEREAS, the JPA provides that before certain Projects can <br />be undertaken, the Project must be approved by the voters and <br />approved unanimously by the LAVWMABoard; and <br /> <br /> WHEREAS, the LAVWMA Board has been discussing its <br />sponsorship of a Project which, if approved, would increase the <br />sewage capacity of LAVWMA by an amount not to exceed 12.7 million <br />gallons (Average Dry Weather Flow) per days and <br /> <br /> WHEREAS, the LAVWMA Board would like the opportunity to <br />proceed on such a Project without the rule of unanimity which <br />currently exists for Projects under the JPA; and <br /> <br /> WHEREAS, if such an amendment to the JPA were made, the <br />Board would intend that such Project be first submitted to the <br />voters of Pleasanton and Livemore and that the LAVWMA Directors <br /> <br /> - I - <br /> <br /> <br />
