In addition to the above, Section 4 (D) contains language establishing a right of way that could
be used for an extension of Stoneridge Dr. to EI Charro at some time in the future should there
be an interest on the part of the City to do so. Essentially, the language indicates that the final
map will establish the right of way which could be used for public utilities, emergency access or
other purposes that are mutually agreed upon by the City and the County; provided that it will
not be used in any way that would impair the potential use as a public roadway. The City
anticipates the right of way will be used for public utilities, the proposed emergency vehicle
access road and to support adjacent land uses. As an example, if Hendrick Automotive acquires
land adjacent to the right of way, the City may allow interim parking and landscaping for the
dealership within the right of way. Uses inconsistent with those mentioned above require
mutual approval between the City and the County. The right of way may not be used for public
purposes such as a trail or City park or for stand-alone facilities.

The right of way will remain the property of the City except that if the City removes from the
General Plan the complete extension/connection of Stoneridge Drive to El Charro, that portion
of the right of way that is not intended to be improved as a public street (as shown on the
development plan) will revert to the Authority's ownership. If this occurs, any development in
the right of way is subject to City approval and in accordance with the MOU; the County agrees
not to build Stoneridge Dr.

FISCAL IMPACT

There is no direct fiscal impact in approving this MOU other than committing the City to an
aggressive processing schedule.

RECOMMENDATION

With the understanding that approval of the MOU (and the attached exhibits) limits in no respect
the Council's discretionary authority concerning this proposed project, staff recommends that
Council authorize the City Manager to sign the MOU.

Respectfully Submitted

f~~ ~~

Assistant City Manager Planning Director

/)Jri Jtad K

Aiv

Michael Roush
City Attorney

Nelson Fialho
City Manager

Attachments

SR:06: 100
Page 4
