Resolution No. 94-032 <br />Page Two <br /> <br />NOW, THEEFOE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />SeCtiOn 1: The City grants and allocates growth management approvals to the following <br /> projects for development: <br /> <br /> Pro_iect 1994 1995 1996 1997 1998 <br /> <br /> Signature Properties (Hacienda Projects)88 108 100 100 100 <br /> Chu/Gahrahmat (Garden Village) 55 24 <br /> <br />Section 2: In addition to the development fees in effect at the time each building permit is <br /> issued, each developer shall pay a growth management/capital facilities fee of <br /> $2,300 per unit for each building permit issued in 1994; this fee shall increase <br /> $100 per unit every year thereafter; this fee is in addition to the growth <br /> management/public needs fee of $750 per unit; and this fee may be replaced if <br /> the City adopts a comprehensive capital facilities fee. <br /> <br /> ~: The Chu/Gahrahmat approval is conditional on the developers' reaching an <br /> agreement with the City by which the developers, if requested by the City, shall <br /> dedicate the park site and street fights-of-way to the proposed school site prior <br /> to the recording of the final map, the final substance and form of which shall be <br /> approved by the City Manager and City Attorney, including provisions to <br /> reimburse the City or the School District for development costs associated with <br /> these infrastructure improvements. <br /> <br /> Section 4: The request of the Prudential Insurance Company to reallocate its 1995 growth <br /> management approvals (231) for its Spanish Oaks project from 1995 to 1997 is <br /> granted; Prudential's 1996 approvals (231) will remain in 1996. <br /> <br /> Section 5: The City Manager is authorized to sign growth management agreements, or an <br /> amendment thereto in the case of the Prudential Insurance Company, in <br /> accordance with this resolution, and the City Manager is authorized to sign <br /> subdivision agreements, or amendments thereto, to coincide with the development <br /> schedules provided herein. <br /> <br /> Section 6: The effect of these growth management approvals shall be to permit development <br /> in accordance with Chapter 17.36 of the Pleasanton Municipal Code, with the <br /> other terms and conditions set forth in this resolution, and with the terms and <br /> conditions of Growth Management Agreements authorized by this resolution. <br /> <br /> <br />
