e. The in-bound right turn curb-return radius at the Owens Drive entry shall be <br /> increased to 40'. <br /> <br /> f. Access to Pared B shall be permitted no closer than 70' from the back of the <br /> curb-return of the Owens Drive entrance. <br /> <br /> g. The parking spaces at the front of th~ building shall be eliminated. The <br /> applicant may, with approval from the City Engineer and Planning Director, redesign <br /> this area to accept a purchased goods loading area with parallel parking. Should the <br /> applicant desire this option, the area shall be ramped from the sidewalk to the loading <br /> area. The loading area shall be differentiated from the drive aisle through the use of <br /> textured or integrally-colored pavement. The area shall be designated for "Customer <br /> Loading Only". <br /> <br /> Should the applicant prefer not to use this option, the area shall be reddesigned with <br /> landscaped islands and a minimum of 5 tree wells with accent trees of at least a 15 <br /> gallon size. <br /> <br />4. If, in the opinion of the City Traffic Engineer, the intersection created at the Owens <br /> Drive median break becomes unsafe because of congestion or accidents, the median <br /> break may be closed or other mitigating measures may be implemented at the option <br /> of the City Traffic Engineer. The developer of this project shall be responsible for <br /> any future mitigation including, but not limited to, re-constructing the median or <br /> installing a traffic signal at this location. The City recognizes that the developer may <br /> enter private agreements (such as Real Estate Agreements), with other property- <br /> owners (such as the owners of the other parcels making up the 32-acre site) who may <br /> share the burden of this obligation. However, the City shall not be party to, nor <br /> responsible for enforcing, such agreements., <br /> <br />5. Delivery trucks and other service vehicles shall be limited to the use of the Rosewood <br /> Drive entry. If, at some future time, the site development includes a separate truck <br /> access driveway, Wal-Mart shall attempt to reach an agreement to be permitted use of <br /> that driveway for permanent service access. <br /> <br />6. Prior to the issuance of building permits, off-site improvement plans shall be subject <br /> to the review and approval of the City Engineer and shall reflect the following: <br /> <br /> a. Precise design of the Owens Drive median islands and striping shall be subject <br /> to the approval of the City Engineer. <br /> <br /> b. The Rosewood Drive signal shall be modified to provide controls for the new <br /> leg of the Rosewood Drive intersection, per the City Engineer. <br /> <br /> B-2 <br /> <br /> <br />
