Section 30 Miscellaneous <br /> 30.1 Review of Acting Engineer <br /> On September 1, 1996 the parties shall meet to review the <br /> use of acting engineer, and determine at that time whether <br /> the limit of one acting engineer shall be increased based <br /> upon financial savings to the City, the training <br /> opportunities for the employees, and an evaluation of <br /> safety, operational and performance issues. <br /> 30.2 Petitioning of PERS <br /> The City will petition PERS in an attempt to modify their <br /> interpretation that the one -time payment provided for in <br /> Section 5.1 of the Memorandum of Understanding is not <br /> subject to PERS contributions. <br /> Section 31. Separability of Provisions <br /> In the event that any provisions of this Memorandum of <br /> Understanding is declared by a court of competent <br /> jurisdiction to be illegal or unenforceable, that <br /> provision of the Memorandum of Understanding shall be null <br /> and void, but such nullification shall not affect any <br /> other provisions of this Memorandum of Understanding, all <br /> of which other provisions shall remain in full force and <br /> effect. <br /> Section 32.
