Upon successfully completing his /her one year probationary <br /> period each new employee shall receive five hundred <br /> thirty -seven and six - tenths (537.6) hours sick leave <br /> credit in addition to that earned during probation. Upon <br /> completion of five (5) years service every employee shall <br /> thereafter accumulate sick leave at a rate of eleven and <br /> two- tenths (11.2) hours per month to a total of 2,016. <br /> For each month an employee maintains a sick leave balance <br /> of 2,016 hours or more, he /she shall be credited with an <br /> additional 11.2 hours of sick leave. In no event shall an <br /> employee accrue more than 2,912 hours of sick leave. An <br /> employee may be allowed a sick leave deficit of thirty - <br /> three and six - tenths (33.6) hours beyond that actually <br /> earned. Employees on leave of absence with pay in lieu of <br /> temporary disability payments pursuant to Section 4850 of <br /> the Labor Code shall accumulate sick leave during said <br /> leave of absence, in accordance with the provisions of <br /> this section. <br /> 14.2 Sick Leave Usage <br /> Sick leave with pay shall be granted to all full -time <br /> employees. Sick leave shall not be considered a right <br /> which an employee may use in his /her discretion, but shall <br /> be allowed only as follows: <br /> (1) In cases of necessity and actual person sickness or <br /> disability of the employee. <br /> (2) For medical and dental appointments of the employee, <br /> at the discretion of the employee's battalion chief <br /> or the fire chief. <br /> (3) For the care of or attendance upon the sickness or <br /> disability of members of his /her immediate family or <br /> for bereavement because of the death of a member of <br /> his /her immediate family. A maximum of seventy -two <br /> (72) hours of sick leave may be used for this <br /> purpose. The immediate family shall consist of the <br /> spouse, children, parents, brothers, sisters or <br /> other individuals whose relationship to the employee <br /> is that of a dependent or near dependent. <br /> The fire chief shall grant such leave and determine <br /> the amount thereof, provided, however, that the <br /> personnel director shall first, where necessary, <br /> pass upon sufficiency of relationship. <br /> This provision does not apply if the family sickness or <br /> disability or the employee's bereavement occurs while the <br /> employee is on vacation leave. <br /> - 16 - <br />
