An employee shall receive an amount equal to five percent <br /> (5 %) of his /her regular hourly rate of pay for each <br /> consecutive hour worked in the acting assignment. <br /> Firefighters and fire engineers serving in an acting <br /> captain assignment shall receive an amount equal to five <br /> percent (5 %) above the fire engineer "E" step salary for <br /> each consecutive hour worked in the acting assignment. <br /> For long term absences expected to last thirty (30) days <br /> or more, the Fire Chief or his /her designee may fill the <br /> absence through a temporary promotion from an eligibility <br /> list. Any employee temporarily promoted shall be paid the <br /> minimum rate for the position to which he /she is promoted, <br /> except that said rate of pay shall be at least five <br /> percent (5 %) above his /her regular rate of pay. <br /> Firefighters and fire engineers temporarily promoted to <br /> captain shall receive an amount equal to five percent (5 %) <br /> above the fire engineer "E" step salary. <br /> Section 8. Court Time <br /> Employees who are required to report to work during their <br /> off -duty time for the purpose of appearing in court shall <br /> be compensated at the eight (8) hour overtime rate, <br /> provided that such compensation be no less than three (3) <br /> hours for court appearances in the Livermore - Pleasanton <br /> Judicial District and four (4) hours for court appearances <br /> outside the Livermore - Pleasanton Judicial District. <br /> Section 9. Holiday Pay <br /> Fifty-six (56) hour work week employees shall be <br /> compensated for working holidays each year through receipt <br /> of holiday in lieu pay. This compensation shall be seven <br /> and one -half percent (7 -1 /2%) of the employee's annual <br /> salary, exclusive of any overtime. Such compensation <br /> shall be paid in two equal installments. Such payments <br /> are to be made on the first payday after December 1 and <br /> the first payday after June 1. <br /> Employees shall receive prorated holiday pay upon <br /> termination. <br /> Section 10. Squad Driver /Operator Pay <br /> Firefighters assigned as driver operators on the <br /> department's rescue squads shall be paid two and one -half <br /> percent (2 -1 /2k) of their regular hourly rate of pay for <br /> all hours so worked in said assignment. No payment shall <br /> be made for hours worked less than one -half a shift. <br /> - 12 - <br />
