Section 26. SeDarabilitv of Provisions <br /> <br /> In the event that any provision of this Memorandum of <br /> Understanding is declared by a court of competent <br /> jurisdiction to be illegal or unenforceable, that <br /> provision of the Memorandum of Understanding shall be <br /> null and void, but such nullification shall not affect <br /> any other provisions of this Memorandum of Understanding, <br /> all of which other provisions shall remain in full force <br /> and effect. <br /> <br />Section 27. Printinq o~ NOU <br /> <br /> The City shall print one hundred fifty (150) copies of <br /> this Memorandum of Understanding in booklet form <br /> including a table of contents. The City and the PeA <br /> shall share the cost of the printing. The PeA shall <br /> assume responsibility of distributing copies to <br /> represented employees. <br /> <br />Section 28. Miscellaneous <br /> <br />28.1 Americans with Disabilities Act <br /> <br /> The City and the Association recognize that the City has <br /> an obligation under law to meet with individual employees <br /> who allege a need for reasonable accommodation in the <br /> workplace because of a disability. If by reason of the <br /> aforesaid requirement the City contemplates action to <br /> provide reasonable accommodation to an individual <br /> employee in compliance with the ADA which are in <br /> potential conflict with any provisions of this Memorandum <br /> of Understanding, the Association will be advised of any <br /> such proposed accommodation and be afforded an <br /> opportunioty to discuss same prior to implementation by <br /> the City. <br /> <br />28.2 Seniority Shift Siqn Up <br /> <br /> The seniority shift sign-up program shall allow for the <br /> three most senior officers assigned to patrol and the one <br /> senior officer assigned to Traffic who possess the most <br /> cumulative years of service in the Pleasanton Police <br /> Department as a Police Officer to exercise their <br /> preference for shift assignments. Those eligible may <br /> select their shifts for a maximum of two continuous <br /> rotations (six months). Once two consecutive rotations <br /> have been completed, those eligible may be assigned to <br /> any one of the three shifts for one rotation provided <br /> that those eligible may submit a priority listing of <br /> shifts for consideration. This provision does not apply <br /> to sergeants. Effective with the implementation of the <br /> "5/9" work schedule, this seniority sign-up provision <br /> shall be eliminated. <br /> <br /> -26- <br /> <br /> <br />
