Section 22. Promot ion <br />Promotional or open - promotional examinations may be conducted whenever in the opinion of the <br />Fire Chief, the needs of the service require. Only employees who meet the requirements set forth <br />in the examination announcements may compete in promotional examinations. <br />Insofar as consistent with the best interest of the department as determined by the Fire Chief, <br />vacancies-in the department shall be filled by promotion from within the department after a <br />promotional examination has been given and a promotional list established. <br />Upon completion of all promotional testing, the names of the persons having the highest three (3) <br />scores on the eligibility list shall be submitted to the Fire Chief for his /her consideration. <br />If, in the opinion of the Fire Chief, a vacancy in the department could be filled better by an <br />open-competitive examination instead of promotional examination, he /she shall arrange an open - <br />competitive employment list consistent with the Personnel Rules. <br />Section 23. Resignation. Reinstatement and Layoff <br />23.1 Automatic Rwiignation <br />Failure to return at the expiration of a leave of absence or being absent without leave shall be <br />considered an automatic resignation. Such a resignation may be rescinded by the Fire Chief if the <br />employee submits satisfactory reasons for his /her absence within three (3) calendar days of the <br />date his /her resignation was effected. <br />23.2 Voluntary Resignation <br />An employee may resign in good standing by submitting to the Fire Chief a written resignation <br />stating the reasons therefor and effective date thereof at least two (2) weeks prior thereto. <br />23.3 Reinstatement <br />With the approval of the Fire Chief, an employee who has resigned in good standing may be <br />reinstated within two (2) years of the effective date of resignation to a vacant position in the same <br />or comparable class. Upon reinstatement, the employee, for all purposes, shall be considered as <br />though the employee had received a new appointment. <br />23.4 Layoff <br />The Fire Chief may lay off an employee because of material changes in duties, organization or <br />shortage of work or funds. <br />17 <br />
