The employee having the least length of total continuous service with the department in <br />classification in which the Fire Chief is laying off, shall be laid off first. <br />Employees scheduled to be laid off may, however, displace the least senior employee in the next <br />lower paying classification of like work who has less seniority. Employees laid off or who <br />through displacement have changed classification shall have their name placed upon a re- <br />employment list in seniority order. The employee with the highest seniority on a re- employment <br />list for a particular classification when a vacancy exists in that classification shall be offered the <br />appointment. No name shall be carried on a re- employment list for a period longer than one (1) <br />year from the date of lay off from Department service or change of classification through <br />displacement. <br />Section 24. Discipline <br />The Department has the right to discipline, demote or discharge employees for cause. <br />Section 25. Grievances <br />25.1 A grievance is any dispute which involves the interpretation or application of any provision <br />of this Memorandum of Understanding excluding, however, those provisions of this Memorandum <br />of Understanding which specifically provide that the decision of any Fire Department official shall <br />be final, the interpretation or application of those provisions not being subject to the grievance <br />procedure. <br />25.2 Grievances shall be processed in the following manner: <br />(1) <br />Within thirty (30) days after the occurrence of an event giving rise to a <br />grievance, an employee or the union may request in writing a meeting to <br />discuss the grievance with the Fire Chief. The Fire Chief or his /her designee <br />shall investigate the grievance and the Fire Chief shall render a decision <br />within fourteen (14) calendar days from the date the grievance was received. <br />(2) Within fourteen (14) calendar days from receipt of the Fire Chief's decision <br />in Step 1 above, the employee or official of the Union may notify the Fire <br />Chief in writing that a grievance exists, stating the particulars of the <br />grievance, citing the specific section of this Memorandum of Understanding <br />he /she believes to have been violated, and, if possible, the nature of the <br />determination desired. The Fire Chief shall have fourteen (14) days from <br />receipt of notification in which to investigate the issues, meet with the <br />complainant and attempt to reach a satisfactory resolution of the problem. <br />No grievance may be processed under paragraph (3) below which has not <br />first been filed and investigated in accordance with this paragraph (2). <br />18 <br />
