15.5 Military Leave <br />Military leave shall be granted in accordance with the provisions of law. All employees entitled <br />to military leave shall give the Appointing Authority an opportunity within the limits of military <br />regulations to determine when such leave shall be taken. <br />15.6 MLA <br />The Department will abide by Federal and State Family Leave Acts. <br />Section 16 Health and Welfare <br />The JPA will study adding PEHMCA. Such study shall commence no later than six months after <br />the formation of the JPA or January 1, 1998, whichever date is earlier. The study will be <br />completed within six months of its commencement. Until such study is completed the employees <br />will be covered for Health and Welfare by the terms of the October 31, 1996 letter of <br />understanding. <br />Section 17. Retirement <br />17.1 Retirement Plan <br />The Department shall continue to provide the PERS 2% at 50 retirement plan to include the <br />present 1959 Survivors and One Year Highest compensation options at the Department's expense. <br />The Department contracts with PERS for the Fourth Level 1959 PERS Survivors Benefit. <br />17.2 Payment of Employee's Contribution <br />The Department shall pay each employee's required PERS on eligible salary and those elements <br />of compensation deemed by PERS to be "PERS Special Compensation" for example, holiday pay, <br />uniform allowance, and paramedic pay. The amount of said Department payment shall equal but <br />not exceed nine percent (9.0 %) of the employee's compensation subject to retirement <br />contributions. <br />17.3 Adoption of Credit for Unused Sick leave Option <br />The Department shall amend its contract with PERS for the purpose of adopting the "credit for <br />unused sick leave" option. The cost of said retirement option shall be borne by the Department. <br />For purposes of determining the amount of unused sick leave for which service credit is to be <br />received, 11.2 hours of sick leave shall be considered one day. <br />14 <br />
