Section 3. Specially Bene~ted Parcels. <br /> <br /> The specially benefited parcels are those shown on the map attached as Exhibit 1. <br /> <br />Section 4. Total Assessment. <br /> <br /> The total assessment chargeable to all the specially-benefited parcels within the Laurel Creek <br />Estates GHAD in each year is equal to the total cost of providing the GHAD services in the <br />identified fiscal year. The total assessment may vary based on changes in the Consumer Price <br />Index CCPI") from year to year. <br /> <br /> The GHAD also has the power under the State of California Public Resources Code to raise <br />bonds for the purpose of paying the costs of CHAD improvements, and to accept financial <br />assistance, including loans, in order to accomplish any purpose of the GHAD statute. Should the <br />GHAD arrange such financing, each parcel on which escrow has closed will be assessed a <br />proportionate amount to reimburse these financial sources. <br /> <br />Section 5. Assessment Per Parcel. <br /> <br /> Each parcel will be assessed $260 per year, plus an annual adjustment to reflect the change in <br />CPI from the previous year. (The automatic CPI adjustment to the assessment is justified because <br />it will correct the assessment to reflect changes in actual costs of operating the CHAD.) The <br />assessment will be levied in perpetuity. In addition, each parcel will be assessed $1,000 at the <br />time of close of escrow for the purpose of establishing a reserve for the CHAD. <br /> <br />Section 6. Methodology for Calculating the Assessment Per Parcel. <br /> <br /> The purpose of the Laurel Creek Estates GHAD is to finance mitigation, abatement and <br />control measures in the event that certain geologic hazards occur and to take the measures <br />described in the POC to prevent those geologic hazards. The basic costs of performing these <br />services are for: Geologist/General Manager; support service; and slope stabilization, erosion <br />protection, and repairs. <br /> <br /> There are 102 parcels in the GHAD which will be bene~ted by the GHAD. As detailed in the <br />POC, the CHAD will utilize specific geotechnical and biotechnical techniques to mitigate <br />landslide and erosion hazards and also will engage in ongoing maintenance and monitoring <br />activities. All the components of the GHAD system will be maintained and monitored with similar <br />intensity; thus, each parcel in the CHAD will receive approximately the same benefits from the <br />CHAD.
