EXHIBIT C <br /> <br /> Notice of Adoption of Resolution by the Board of Directors <br /> of Laurel Creek Estates <br /> Geologic Hazard Abatement District <br /> <br />On November 18, 1997. the City Council of the City of Pleasanton, California, adopted <br />Resolution No. 97-135 roving the formation of a geologic hazard abatement district CGHAD") <br />for the Laurel Creek Estates area and appointing itself to act as the Board of Directors of the <br />GHAD. The GHAD was formed pursuant to State Public Resources Code Section 26500 et seq. <br />for the purpose of prevention, mitigation, abatement and control of certain geologic hazards. <br /> <br />NOTICE IS HEREBY GIVEN that: <br /> <br />On December 1, 1998, the City Council adopted Resolution 98-151 setting a Public Hearing to <br />consider adoption of an assessment to finance the GHAD. If the assessment is adopted, each <br />parcel you own will be assessed $260 per year, plus an annual adjustment to reflect the <br />percentage change in the Consumer Price Index CCPI") over the previous twelve-month period. <br />The assessment will be levied at the time the City formally accepts the public improvements in <br />the Laurel Creek Estates development, estimated to commence in Fiscal Year 1999-2000. The <br />assessment shall continue to be levied in perpetuity. In addition, each parcel will be assessed <br />$1,000 at the time of close of escrow for the purpose of establishing a reserve amount for the <br />GHAD. <br /> <br />The attached Engineer's Report for the Laurel Creek Estates GHAD was prepared by the GHAD <br />Geologist/General Manager and by a registered professional engineer certified in the State of <br />California, and describes in detail the reason for the assessment and the basis upon which the <br />amount of the proposed assessment was calculated. The Engineer's Report specifically sets forth <br />the yearly estimated budget, the total assessment that will be chargeable to the entire GHAD, the <br />proposed estimated assessments to be levied each year against each parcel of property, and a <br />description of the method used in formulating the estimated assessment. A copy of the <br />Engineer' s Report is also available for inspection at the office of the City Engineer, 200 Old <br />Bernal Avenue, Pleasanton, California. <br /> <br />The City Council will conduct a Public Hearing on January 19, 1998 at 6:55 p.m. in the City <br />Council Chambers, 200 Old Bernal Avenue, Pleasanton, California, to tabulate Ballots and to <br />hear any protests on the proposed assessment. <br /> <br />The following paragraph provides the procedures for returning and tabulating the Ballots. A <br />copy of this Notice, Ballot and Engineer's Report has been sent to each of the property owners <br />within the GHAD; your Ballot is attached to this Notice.
