EXHIBIT "B" <br /> <br /> CONDITIONS OF APPROVAL <br /> Case UP-98-46 <br /> (October 20, 1998) <br /> <br />1. The construction and operation of the proposed martial arts studio shall substantially <br /> conform to the floor plan, site plan, and written narrative, Exhibit "A", dated "Received <br /> July 7, 1998", on file with the Planning Department, except as modified by the following <br /> conditions. Minor changes to the plans may be allowed subject to the approval of the <br /> Planning Director if found to be in substantial conformance with the approved exhibits. <br /> <br />2. Hours of operation and class sizes shall be limited to those listed in Exhibit "A", dated <br /> "Received July 7, 1998". Special events, such as award ceremonies and tournaments, <br /> shall be held on Fridays between 7:00 p.m.. and 8:00 p.m. only. If additional hours of <br /> operation or increased class sizes are desired, prior City review and approval is required. <br /> Details of such modifications shall be submitted to the Planning Director, who may <br /> approve the modification if it is judged to be minor. The Planning Director may refer the <br /> matter to the Planning Commission for a public hearing if judged to be substantial. <br /> <br />3. There shall be at least a 15 minute break between all martial arts classes. During the 15 <br /> minute break, no classes shall be held. <br /> <br />4. The doors of the martial arts studio shall be closed at all times except for ingress/egress or <br /> emergency purposes. <br /> <br />5. The manager of the martial arts studio shall inform all students not to loiter or make loud <br /> noises outside the building before or after classes. The inability of the manager to <br /> regulate the students to prevent such nuisances shall be cause for flirther review and <br /> possible revocation of this use permit by the Planning Commission. <br /> <br />6. The applicant shall submit a noise study by an acoustical engineer, approved by the <br /> Building Department, within 60 days of the date of approval for this case, Case <br /> UP-98-46. On two separate days, the acoustical engineer shall measure the noise level in <br /> the applicant's tenant space while the applicant is providing martial arts lessons. If the <br /> noise level in the martial arts studio exceeds 50 dBA, then within 30 days the applicant <br /> shall construct a noise muffling wall along the northern and southem side building walls <br /> of the site to attenuate noise from the martial arts classes. The walls shall be designed to <br /> achieve an STC rating of 45-50, subject to the satisfaction of the Chief Building Official. <br /> <br /> <br />
