the period of suspension is completed and the operator <br /> has presented proof of the reimbursement. <br /> <br />I. Failure of the operator to comply with the inspection <br /> requirements of this Agreement Shall be cause for <br /> suspension. The period of the suspension shall be <br /> determined by the Police Chief. The suspension will <br /> remain in effect until the period of suspension is <br /> completed and the operator has complied with the <br /> inspection requirement. <br /> <br />J. Failure of the operator to maintain the minimum insurance <br /> requirements set forth in the Agreement shall be cause <br /> for suspension. The period of suspension shall be <br /> determinedby the Chief of Police. The suspension shall <br /> remain in effect until the notice of suspension is <br /> completed and the operator has complied with the <br /> insurance requirements. The operator may be subject to <br /> an additional suspension for failure to notify the Police <br /> Department in advance of the insurance policy expiration <br /> or cancellation. <br /> <br />K. Failure of the operator or employee to comply with <br /> Section 14, Demeanor and Conduct, and\or Section 15, <br /> Compliance with Agreement, may be case for suspension. <br /> <br /> 1. Minor traffic violations may be considered as minor <br /> violations of the Agreement. <br /> <br /> 2. A tow truck driver, not under the immediate <br /> observation of the operator, while on-duty and <br /> driving a tow truck who is arrested and subsequently <br /> convicted for misdemeanor driving under the <br /> influence of alcohol and\or drugs,will be subject to <br /> suspension from participating as a tow truck driver <br /> under the provisions of this Agreement. The length <br /> of suspension will be determined by the Police <br /> Chief. <br /> <br />L. If the operator is serving a suspension for one year or <br /> more, the operator shall be required to comply with all <br /> terms and conditions of the current Agreement at the time <br /> of the reinstatement. There will be no approval of <br /> equipment that is not in compliance with the equipment <br /> specifications contained in the Agreement at the time of <br /> reinstatement. Elements of this Agreement which are <br /> commonly referred to as "grandfather clauses" shall no <br /> longer apply to the operator who is suspended for one <br /> year or more. <br /> <br />M. Violations of the Agreement that are subject to <br /> suspension for a first violation are categorized as <br /> <br /> -18- <br /> <br /> <br />
