findings within 30 days of the conclusion of the <br /> investigation. <br /> <br />16. DISCIPLINARY ACTION <br /> <br /> A. The Police Chief shall take disciplinary action against <br /> operators for violations investigated and confirmed or <br /> sustained. The Police Chief shall retain discretion <br /> regarding the length of any suspension imposed pursuant <br /> to this Agreement. <br /> <br /> B. Records of violations shall be retained by the Police <br /> Department for at least three (3) years. <br /> <br /> C. A violation of the equipment requirements related to <br /> safety shall be cause for immediate suspension. The <br /> period of the suspension shall be determined by the <br /> Police Chief. The suspension will remain in effect until <br /> the period of suspension is completed and the Police <br /> Department has conducted an inspection and found that the <br /> operator is in compliance. <br /> <br /> D. A violation of the GVWR and safe loading requirements of <br /> a tow truck shall be cause for immediate suspension. <br /> This includes exceeding the tow truck's GVWR, or not <br /> maintaining 50% of the tow truck's unladen weight on the <br /> front axle when lifting\carrying a load. <br /> <br /> E. A violation of overcharging shall be cause for <br /> suspension. The period of the suspension shall be <br /> determined by the Police Chief. The suspension will <br /> remain in effect until the period of suspension is <br /> completed and the operator has presented proof to the <br /> police department that reimbursement has been made to the <br /> aggrieved customer. <br /> <br /> F. A violation of the Biennial Inspection of Terminals (BIT) <br /> Program requirements shall be cause for suspension. Any <br /> unsatisfactoryrating shall be cause for suspension. The <br /> period of the suspension shall be determined by the <br /> Police Chief. The suspension will remain in effect until <br /> the period of suspension is completed and the operator <br /> has presented proof of compliance with the BIT <br /> requirements. <br /> <br /> H. Failure of the operator to satisfy a court order <br /> mandating reimbursement to the vehicle or property owner <br /> for the damage or loss which occurred while the vehicle <br /> was in his\her custodyshall be cause for suspension. The <br /> period of the suspension shall be determined by the <br /> Police Chief. The suspension will remain in effect until <br /> <br /> -17- <br /> <br /> <br />
